Peter Gary's Will
Peter Gary will, estate #39, 1843 - Recorded in Somerset County, Pennsylvania
I Peter Gary of Turkeyfoot Township State of Pennsylvania farmer do make and publish this my last will and testament hereby revoking and making void all former wills by me at any time heretofore made. And first I direct that my body be decently intered in the burying ground on the plantation wheron Christian Schrack now lives. And that my funeral be conducted in a manner corresponding with my Estaate and Situation in life. And as to such wordly estate as it hath pleased God to entrust me with I dispose of the same as follows. First I direct that all debts and funeral expenses be paid as soon after my decease as possible out of that part of personal estate which my widow (if then aliving) may be best able to spare. I then direct that my Real Estate consisting of the plantation whereon I now reside and the remainder of my personal property after my just debts and funeral expenses be paid as aforesaid be and remain the absolute property of my beloved wife so long as she shall live and remain my widow for her support and comfort. (Not that she shall r dispose of or sell any part of my real estate and after the decease of my widow then I direct that if any personal property be left that my children if they can agree may divide it equally between them but if the cannot agree then I direct that my Executor make sale of the same and divide the proceeds equally between them (after the expenses thereof are defrayed). And at the death of my widow if any of my said children be of the ability and chooses may take my real estate at an appraised price or otherwise as they may agree but if they cannot agree then I direct that my said executor proceed to sell the same and upon such conditions as he may consider advantages to my children and after the expenses thereof be defrayed then the balance of the proceeds thereof be divided by my said executor equally among all my children share and share alike. And I do authorize my said executor to execute a deed or deeds of conveyance as may be necessary to the purchaser or purchasers of my real estate so as to secure the same to him or them. And I do hereby make and ordain my Esteemed Neighbor William Henry Executor of this my last will and testament. In witness whereof (turn over) I Peter Gary the testator have to this my will written on one half sheet of paper Set my hand and Seal this twenty second day of April in the year of our Lord one thousand eight hundren and forty three.
